The purpose of this essay is to advocate for including jurilinguistics in legal education. It presents jurilinguistics as a tool for understanding law and therefore supports continuing efforts to teach it. Knowing it is not unique, this essay proposes a jurilinguistic approach that focuses on the in-between of legal translation and comparative law. The proposal outlines the importance of educating in the capabilities of teaching a particular subject in a language other than their official one. The idea is to let (...) the Other help to understand the Self. Particularly pertinent in transnational law programs, it is a multicultural approach that not only recognizes the other, but also embraces it. (shrink)

In this paper we argue that the different positions taken by Dyson and Feynman on Feynman diagrams’ representational role depend on different styles of scientific thinking. We begin by criticizing the idea that Feynman Diagrams can be considered to be pictures or depictions of actual physical processes. We then show that the best interpretation of the role they play in quantum field theory and quantum electrodynamics is captured by Hughes' Denotation, Deduction and Interpretation theory of models (DDI), where “models” are (...) to be interpreted as inferential, non-representational devices constructed in given social contexts by the community of physicists. Smith y sus antecesores en la Ilustración escocesa, y explorar desde un nuevo ángulo el lugar que ocupa la política en la obra de Smith. Al pasar de una figura universal y abstracta, a una concreta y real, el sistema de la simpatía permite pensar en la continuidad que hay entre (...) la comunidad moral y la comunidad política y también en su ruptura, cuando la segunda se convierte en el espacio que permite manejar la exclusión que puede generar la primera. La invisibilidad de algunos miembros de la comunidad moral exige la creación de un espacio de tolerancia para evitar la violencia simbólica que implica la negación de participar en la comunicación afectiva de la simpatía. ABSTRACT The system of sympathy introduces a change in the figure of the other with respect to the school of moral sense. The reconstruction of this change reveals an important difference between A. Smith and his Scottish Enlightenment predecessors, which allows for the examination of the role of politics in Smith's work from a new angle. By replacing an abstract, universal figure with a concrete, actual one, the system of sympathy makes it possible to think the continuity between the moral community and the political community, but also its disruption, whenever the latter becomes a space to handle the exclusion that might be generated by the former. The invisibility of some of the members of the moral community requires the creation of a space of tolerance in order to avoid the symbolic violence entailed by the refusal to participate in the affective communication of sympathy. RESUMO Ao reconstruir a mudança na figura do outro entre a escola do sentido moral e o sistema da simpatia, é possível estabelecer uma diferença importante entre A. Smith e seus antecessores na Ilustração escocesa e explorar, sob um novo ângulo, o lugar que a política ocupa na obra de Smith. Ao passar de uma figura universal e abstrata para uma concreta e real, o sistema da simpatia permite pensar na continuidade que há entre a comunidade moral e a comunidade política e também em sua ruptura, quando a segunda se converte no espaço que permite manejar a exclusão que pode gerar a primeira. It is specified in the penetration of technological and biopolitical frameworks in the ways of life of the population worldwide and in the notions regarding how to live, and in the colonial matrix of knowledge / power that is at the base of the historical conception of the world system. En este artículo, nos preguntamos si es pertinente un análisis del personaje de Medea de Eurípides, y más concretamente, de su filicidio, a la luz de la doctrina aristotélica de la acción. Resulta dudoso, y quizás equívoco, hablar de "responsabilidad" (en sentido aristotélico) en el caso de la heroína, ya que sus motivaciones, como las de todo héroe trágico, tienen un doble signo: enfrentado a una ἀνάγκη superior, también desea lo que está forzado a hacer. Además, Medea no es una (...) mujer común: es un personaje ontológicamente complejo que participa, más de lo que frecuentemente se ha enfatizado, del plano divino. In this article we wonder if it is pertinent to analyse the character of Euripides' Medea and, more precisely, her filicide, in the light of Aristotle's doctrine of action. With regard to the heroine, it is doubtful and perhaps confusing to talk about "responsibility" (in Aristotelian terms) because her motivations, as all tragic heroes', are two-sided: faced to a superior ἀνάγκη he wants what he is forced to do as well. In addition, Medea is not an ordinary woman: she is an ontologically complex character that has a share in the divine level, a share which is more crucial than what has usually been emphasized. Alberto Magno designa una división tripartita para la filosofía, en la cual la “filosofía real” se encuentra compuesta por la física, la matemática y la metafísica, dispuestas de este modo secundum ordinem doctrinae. El saber metafísico constituye el saber más excelso y es denominado scientia divina, que se articula con la teología a modo de una gradación de distintos estadios de inteligibilidad, y pone de manifiesto el problema dialéctico fe-razón.

En este artículo teórico se presenta el modelo metodológico de los Mapas Corporales como una estrategia para la producción de conocimientos sobre el cuerpo en investigaciones biográficas. Este modelo aborda la corporeidad como un lugar por el que fluye el trazado de construcciones intersubjetivas que regulan al sujeto, permitiendo textualizar procesos subjetivos que, con las estrategias tradicionales del método biográfico, quedan invisibles, en tanto, lenguajes semiótico-materiales encarnados. A nivel interpretativo se busca la comprensión del orden normativo inscrito en el cuerpo (...) donde se articulan aspectos relativos a procesos psicosexuales y modelos de género anclados en la cultura, como así también, la expresión de transgresiones o disidencias a las ideologías de género vigentes. This theoretical paper refers to a methodological model of Body Maps as a strategy to create knowledge on corporeity in bibliographic research. This model approaches the body as a place through which the intersubjective construction path regulating the subject flows, allowing the textualization of subjective processes which, together with the traditional strategies of the bibliographic method, remain invisible as embodied semiotic-material languages. At an interpretational level, the paper deals with understanding the normative order of the body where aspects relative to psychosexual processes and gender models rooted in the culture articulate, along with the expression of transgression to current gender ideologies. La literatura griega registra antecedentes de los recursos propios del slapstick en diversos géneros como la épica, la poesía yámbica, la fábula y la comedia. La comedia de Menandro, en particular El Misántropo, hace uso profuso de esta serie de tópicos del humor físico para caracterizar al anciano Cnemón, su personaje central. En varias de sus obras, el slapstick se asocia específicamente al personajetipo del anciano gruñón. El Misántropo retoma claramente el uso punitivo tradicional del recurso, que resulta dominante en (...) la comedia de Aristófanes, en cuanto el slapstick apunta a castigar y transformar la conducta antisocial de Cnemón. No se trata de un recurso asociado al mero entretenimiento, sino que condena a su víctima mediante el escarnio de la agresión y la risa, o bien a su victimario cuando ejerce una violencia descontextualizada, como lo hace el misántropo. El trabajo se propone analizar la representación de la ira en la comedia de Menandro y, en particular, la operación de ‘tipificación’ de la cólera en su obra, que se vincula con la construcción de personajes-tipo. Adoptamos como marco teórico algunos lineamientos de la concepción aristotélica de las pasiones y del constructivismo social. En este marco, sostenemos que la ira en la comedia de Menandro se encuentra atravesada por determinaciones de edad, género y condición libre o esclava y se presenta, (...) sobre todo, como un rasgo negativo dominante del ciudadano varón anciano y cabeza del hogar. ArgumentIn 1895 when the Lumière brothers unveiled their cinematographic camera, many scientists were elated. Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...) to belong to the non-representational wing of cognitive science, predictive processing has a representational profile. And secondly, because they exhibit different explanatory strategies: while Sensorimotor Enactivism prioritizes the interactions of the embodied agent, predictive processing has internalist commitments. The aim of this paper is to address these concerns and show that a predictive approach to Sensorimotor Enactivism is viable. More specifically, I focus on the Free-Energy approach, a theory that falls within the ballpark of predictive processing. In this paper I argue for the following claims. I argue that both Sensorimotor Enactivism and the Free-Energy approach may be understood for some systems in representational terms. The non-representational reading of Sensorimotor Enactivism is not mandatory and neither is the representational reading of the Free-Energy approach. Sensorimotor Enactivism is, in this respect, compatible with both representational and non-representational interpretations of the FEA. So, the position towards representations of these frameworks should not stand in the way of a predictive approach to Sensorimotor Enactivism. I also show that the Free-Energy approach allows for an account that prioritizes the interaction of the embodied agent with the environment. This is the explanatory strategy followed by Sensorimotor Enactivism. To justify this strategy and following other proponents of Sensorimotor Enactivism, I argue that by referring to the interactions of the embodied agent a better account of the phenomena in question is provided. On this basis, I claim that Sensorimotor Enactivism and the Free-Energy approach are compatible in what concerns their explanatory strategy as well. Thus, making the case for the viability of the predictive approach to Sensorimotor Enactivism. (shrink)

Presentamos un análisis sobre la manera en que el desarrollo del capitalismo y, al mismo tiempo, del patriarcado, ha atado a las mujeres a situaciones de violencia a partir de la dependencia económica. The year 2005 has been named the World Year of Physics in recognition of the 100th anniversary of Albert Einstein's "Miracle Year," in which he published four landmark papers which had deep and great influence on the last and the current century: quantum theory, general relativity, and statistical mechanics. Despite the enormous importance that Einstein’s discoveries played in these theories, most physicists adopt a version of quantum theory which is incompatible with the idea that motivated Einstein in the first place. (...) This seems to suggest that Einstein was fundamentally incapable of appreciating the `quantum revolution,’ and that his vision of physics as an attempt to reach a complete and comprehensive description of reality was ultimately impossible to obtain. Relativity theory has provided us with a picture of reality in which the world can be though as independent on who observes it, and the same can be said for statistical mechanics. Instead, quantum mechanics seems to suggest that physical objects do not exist `out there’ when someone is not observing them. In this framework, it is often suggested that any kind of causal explanation is impossible in the atomic and subatomic world, and therefore should be abandoned. This is why many think that it is in principle impossible for quantum theory to provide us with a coherent and comprehensive view of the world, in contrast with what happens with relativity and statistical mechanics. Is it really impossible to pursue Einstein’s ideal of physics also in the quantum framework? This book argues that this is not the case: the central idea is that Einstein’s vision of physics is still a live option, and indeed it is the one that best allows obtaining a unitary understanding of our physical theories. Within the current mainstream research in the foundations of physics, much attention has been turned to the program of Axiomatic Reconstruction of Quantum Theory in terms of Information-Theoretic principles (ARQIT). ARQIT aims at finding a few general information-theoretic principles from which, once translated into mathematical terms, one can formally derive the structure of quantum theory. This chapter explores the role of mechanistic explanations and mathematical explanations (in particular, structural explanations) within ARQIT. With such considerations as a point of departure, we (...) investigate how ARQIT contributes to the explanation of quantum phenomena, and the possible prospects for explanations provided by mechanical interpretations of quantum theory. This paper offers a critical assessment of the current state of the debate about the identity and individuality of material objects. Its main aim, in particular, is to show that, in a sense to be carefully specified, the opposition between the Leibnizian ‘reductionist’ tradition, based on discernibility, and the sort of ‘primitivism’ that denies that facts of identity and individuality must be analysable has become outdated. In particular, it is argued that—contrary to a widespread consensus—‘naturalised’ metaphysics supports both the acceptability (...) of non-qualitatively grounded (both ‘contextual’ and intrinsic) identity and a pluralistic approach to individuality and individuation. A case study is offered that focuses on non-relativistic quantum mechanics, in the context of which primitivism about identity and individuality, rather than being regarded as unscientific, is on the contrary suggested to be preferable to the complicated forms of reductionism that have recently been proposed. More generally, by assuming a plausible form of anti-reductionism about scientific theories and domains, it is claimed that science can be regarded as compatible with, or even as suggesting, the existence of a series of equally plausible grades of individuality. The kind of individuality that prevails in a certain context and at a given level can be ascertained only on the basis of the specific scientific theory at hand. (shrink)

The speed of light, explained Einstein, was an unsurpassable velocity if , and only if , it was considered in terms of »arbitrary« and »voluntary« signals. Light signals in physics belong within a broader set of signs and symbols that include communication and military signals, understood by reference to Helmholtz, Saussure, media philosophies from WWII to '68 (Lavelle, Ong, McLuhan) and Derrida. Once light signals in physics are considered (...) in relation to semaphore, print, telegraph, radio, computers and tape recorders, Kittler and Habermas provide us with conflicting ways for understanding science and technology, rationality and consensus. We conclude with a study of »flash and bang« in popular accounts of relativity theory to understand the role of theoretical science in the transmission of information and violence. (shrink)

In particular, we propose to conceive of spatial superpositions of non-massless microsystems as dispositions or powers, more precisely propensities, to generate spontaneous localizations. We set out five reasons for this view, namely that (1) it provides for a clear sense in which quantum systems in entangled states (...) possess properties even in the absence of definite values; (2) it vindicates objective, single-case probabilities; (3) it yields a clear transition from quantum to classical properties; (4) it enables to draw a clear distinction between purely mathematical and physical structures, and (5) it grounds the arrow of time in the time-irreversible manifestation of the propensities to localize. In the first part of the paper I argue that an ontology of events is precise, flexible and general enough so as to cover the three main alternative formulations of quantum mechanics as well as theories advocating an antirealistic view of the wave function. Since these formulations advocate a primitive ontology of entities living in four-dimensional spacetime, they are good candidates to connect that quantum image with the manifest image of the world. However, to the extent that some form of (...) realism about the wave function is also necessary, one needs to endorse also the idea that the wave function refers to some kind of power. In the second part, I discuss some difficulties raised by the recent proposal that in Bohmian mechanics this power is holistically possessed by all the particles in the universe. (shrink)

Los cuidados paliativos son una forma de atención integral del paciente, considerando su carácter antropológico y ontológico, como un ser biopsicosocioespiritual, en donde la muerte y el sufrimiento son características que lo definen y lo separan de otra especie. Los principios bioéticos nos dan una aproximación para entender el porqué es importante atender al paciente desde todos los ámbitos, más allá de la intención curativa. Nos permite visualizar la verdadera meta de los cuidados paliativos.

Debates about the ontological implications of the general theory of relativity have long oscillated between spacetime substantivalism and relationism. I evaluate such debates by claiming that we need a third option, which I refer to as “structural spacetime realism.” Such a tertium quid sides with the relationists in defending the relational nature of the spacetime structure, but joins the substantivalists in arguing that spacetime exists, at least in part, independently of particular physical objects and events, the degree of “independence” being (...) given by the extent to which geometrical laws exist “over and above” physical events exemplifying them. By showing that structural spacetime realism is the natural outcome of a semantic, model-theoretic approach to the nature of scientific theories, I conclude by arguing that the notion of partial isomorphic representation is the most plausible candidate to connect spacetime models with reality. In this paper, we review and connect the three essential conditions needed by the collapse model to achieve a complete and exact formulation, namely the theoretical, the experimental, and the ontological ones. These features correspond to the three parts of the paper. In any empirical science, the first two features are obviously connected but, as is well known, among the different formulations and interpretations of non-relativistic quantum mechanics, only collapse models, as the paper well illustrates with a richness of details, (...) have experimental consequences. Finally, we show that a clarification of the ontological intimations of collapse models is needed for at least three reasons: (1) to respond to the indispensable task of answering the question ’what are collapse models (and in general any physical theory) about?’; (2) to achieve a deeper understanding of their different formulations; (3) to enlarge the panorama of possible readings of a theory, which historically has often played a fundamental heuristic role. In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. We discuss the three dominant models of the phenomenological literature pertaining to temporal consciousness, namely the cinematic, the retentional, and the extensional model. This is first done by presenting the distinction between acts and contents of consciousness and the assumptions underlying the different models concerning both the extendedness and duration of these two components. Secondly, we elaborate on the consequences related to whether a perspective of direct or indirect realism about temporal perceptions is assumed. Finally, we review some relevant findings (...) from the psychology and neuroscience of temporality in order to decide which of the three models of time consciousness is better confirmed from an empirical viewpoint. Depending on the time scale, all three models of temporal consciousness might apply. We specifically argue in favor of an extensional model of time consciousness for the experienced present where the acts and contents of consciousness are both extended. The retentional model might apply to longer time intervals covered by working memory. In addition, a predictive component is highlighted as decisive for an understanding of temporality. (shrink)
